Terms and Conditions – Iceberg Wheels

Welcome to Iceberg Wheels! These Terms and Conditions govern your use of our online platform and the car rental services we offer. By accessing or using our website and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.

1. Definitions

• "Iceberg Wheels," "we," "us," or "our" refers to the car rental company, Iceberg Wheels.
• "Customer," "you," or "your" refers to the individual or entity booking or using our car rental services.
• "Vehicle" refers to any car, truck, van, or other vehicle provided by Iceberg Wheels for rental.
• "Rental Agreement" refers to the specific contract signed by the Customer at the time of vehicle pickup, detailing the terms of that particular rental.
• "Service" or "Services" refers to the car rental booking and information services provided through our online platform.

2. Eligibility for Rental

To rent a Vehicle from Iceberg Wheels, you must:

• Be at least 21 years of age (age requirements may vary based on vehicle class and local legislation).
• Possess a valid, full, and unendorsed driver's license held for a minimum period (typically 1-2 years, depending on location and vehicle type) from your country of residence. An International Driving Permit may be required for non-English licenses.
• Present a valid credit card in your name for security deposit and payment purposes. Debit cards may be accepted under specific conditions.
• Present valid identification, such as a passport or national ID card.

3. Booking and Reservations

Bookings can be made through our online platform. All reservations are subject to vehicle availability. A confirmation will be provided upon successful booking, which includes specific rental details. While we strive to provide the exact vehicle model booked, we reserve the right to substitute a vehicle of similar or higher class if the reserved model is unavailable.

4. Pricing and Payment

Rental prices displayed on our site are for the vehicle rental only and may exclude fuel, optional extras, insurance excess, road tolls, fines, and other charges unless explicitly stated. Full payment or a deposit may be required at the time of booking. The remaining balance and any additional charges will be processed at vehicle pickup or return. All payments are processed securely. Prices are subject to change without prior notice, but any changes will not affect confirmed bookings.

5. Vehicle Pickup and Return

• Pickup: Upon pickup, you must present all required documentation. You will inspect the Vehicle for any existing damage and acknowledge its condition by signing a Rental Agreement. Any damage not recorded at pickup will be deemed to have occurred during your rental period.
• Return: The Vehicle must be returned to the agreed-upon location and time, in the same condition as received, allowing for fair wear and tear. Late returns may incur additional charges. The fuel policy (e.g., full to full, full to empty) will be clearly stated in your Rental Agreement.

6. Rental Period and Extension

The rental period is calculated on a 24-hour basis. If you wish to extend your rental, you must contact Iceberg Wheels directly before your scheduled return time. Extensions are subject to vehicle availability and approval, and additional charges will apply.

7. Insurance and Liability

All rentals include basic insurance coverage as per local regulations. This typically includes third-party liability insurance. However, an insurance excess/deductible will apply in the event of damage to the Vehicle or theft, regardless of fault. Optional additional insurance products (e.g., Excess Waiver, Personal Accident Insurance) may be available for purchase to reduce your liability. You are responsible for any damage not covered by insurance, including damage due to negligence or breach of the Rental Agreement.

8. Vehicle Use Restrictions

The Vehicle must not be used:

• By anyone other than the registered drivers listed on the Rental Agreement.
• To carry passengers or goods for hire.
• For racing, speed testing, or any illegal activities.
• Off-road or on unsuitable terrain.
• While under the influence of alcohol or drugs.
• To propel or tow any vehicle or trailer.
• Outside the geographical limits specified in the Rental Agreement.

Breach of these restrictions may void your insurance coverage and result in significant financial penalties.

9. Accidents and Breakdowns

In the event of an accident, breakdown, or damage to the Vehicle, you must:

• Ensure the safety of all parties.
• Contact emergency services if necessary.
• Notify Iceberg Wheels immediately.
• Not admit fault or liability.
• Obtain details of all third parties involved (names, addresses, insurance details, vehicle registration).
• Cooperate fully with Iceberg Wheels and our insurance provider.

10. Fines and Penalties

You are responsible for all parking fines, traffic violations, speeding tickets, tolls, and any other penalties incurred during the rental period. An administration fee may be charged by Iceberg Wheels for processing and forwarding these to you.

11. Modifications to Terms

Iceberg Wheels reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services after such changes constitutes your acceptance of the new Terms. Please review these Terms regularly.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
